1. Introductory provisions
The Seller and the operator of the website www.ramissio.com is the company RAMISSIO LTD, registration number: 09403996, with its registered office at Q 35A Astbury Road, SE15NL London, United Kingdom of Great Britain and Northern Ireland, which operates in the Czech Republic through its organizational unit known as RAMISSIO LTD, a spin-off plant, registration number: 04201540, with its registered office at Za Hládkovem 973/4, Prague 6, Postal Code 169 00 (hereinafter referred to as the "Seller"). The contact details of the Seller, through which it can be reached by individual customers within the meaning of these Terms and Conditions, is as follows: e-mail objednavky@ramissio.com. An integral part of these Terms and Conditions are the documents - Information on the processing of personal data and Consent to the processing of personal data, with the fact that the circumstance of acquaintance with them, or the granting of the relevant consent, is always expressed by the buyer separately (all the documents mentioned together with this document are hereinafter referred to collectively as the "Terms and Conditions"). In the event of a conflict between any of the provisions of the Terms and Conditions and the concluded contract, the provisions of the contract of sale shall always prevail. The use of the Buyer's terms and conditions is excluded, even in matters not covered by the terms and conditions. Goods means the entire range of products and products that are listed in the Seller's online shop (e-shop), which is operated on the website www.ramissio.com. The Seller's flagship products that can be purchased through the relevant website are Ramissio food supplements. As an essential part of the order, the Buyer confirms that he/she has read and agrees to these Terms and Conditions. By submitting an order, the customer confirms his/her acceptance of the contract and the terms and conditions. Upon delivery of the order to the seller, the purchase contract is concluded. Upon receipt of the order, the buyer will automatically receive an e-mail confirmation of receipt of the order and a total summary of the goods ordered. A tax receipt with the exact amount, adjusted for any individual discounts, will be sent to the Buyer after the goods have been dispatched. When purchasing on the website www.ramissio.com, contracts are concluded only in Czech, for the conclusion of a contract in another language, individual means of communication (e.g. e-mail) may be used, in which case these terms and conditions may be individually incorporated into the contract. These terms and conditions do not apply to cases where the person who intends to purchase goods from the seller is a person who is acting in the course of his/her business or profession when ordering goods. In such cases, means of individual communication (e.g. e-mail) may be used to conclude the contract and these terms and conditions may be incorporated into the contract on an individual basis, provided that they apply to the buyer's position to the extent that they are not granted only to consumers.
2. Basic pre-contractual communication
The Seller discloses that:
where the buyer is a consumer, such consumer has the right to withdraw from the contract within fourteen days of the date on which the consumer or a third party designated by the consumer (other than the carrier) takes physical possession of the goods, and the notice of the exercise of the right to withdraw must be sent by the consumer to the physical or electronic address of the seller before the expiry of that period. The consumer is entitled to use the withdrawal form on the seller's website;
the consumer cannot withdraw from a contract for the supply of goods which are supplied in sealed packaging and which cannot be returned for health or hygiene reasons if the consumer has already removed them from the packaging;
in the event of withdrawal, the consumer shall bear the costs of returning the goods and, in the case of a contract concluded by means of distance communication, the costs of returning the goods if they cannot, by their nature, be returned by the normal postal route;
if the consumer has a complaint or is dissatisfied with the handling of his complaint, he may pursue it with the seller or, where appropriate, refer the complaint to a supervisory authority or a state supervisory authority;
the consumer is also entitled to resolve any disputes with the seller through an out-of-court consumer dispute resolution body. Before initiating proceedings, it is necessary to lodge a complaint with the seller, who is obliged to deal with it within 30 days. The out-of-court settlement can then be initiated no later than the 30th day after the day on which the consumer lodged the complaint with the seller. The consumer may initiate out-of-court dispute resolution with the designated entity, which is the Czech Trade Inspection Authority, Central Inspectorate - ADR Department, Štěpánská 567/15, Prague 2, Postal Code 120 00, email: adr@coi.cz, web address: adr.coi.cz, or through the online dispute resolution platform established by the European Commission at http://ec.europa.eu/consumers/odr/.
3. The process of concluding the purchase contract
The subject matter of the concluded purchase contract is only the items expressly stated in the accepted order (hereinafter referred to as "the goods"). The Seller undertakes to deliver to its customers:
faultless goods in accordance with the specification or with the characteristics usual for the type of goods,
complying with the relevant legal standards, rules and regulations,
provided with package leaflets or descriptions in English.
The proposal to conclude a purchase contract (offer) is the placement of the offered goods by the seller on the e-shop website, the purchase contract is concluded by delivery of the buyer's order to the seller. The seller is not responsible for any errors in data transmission.
The Seller shall immediately confirm the conclusion of the contract to the Buyer by informative e-mail to the e-mail address provided by the Buyer. The current version of the Seller's terms and conditions is attached to this confirmation.
Before sending the order to the Seller, the Buyer shall be allowed to check and change the data entered by the Buyer in the order, including with regard to the Buyer's ability to detect and correct errors made when entering data into the order
The Buyer sends the order to the Seller by clicking on the "Send Order" button.
The condition for the validity of the electronic order is the completion of all the data and details prescribed by the form and marked as necessary, including confirmation by the buyer that he has read and agrees to the terms and conditions.
Depending on the nature of the subject of the order (quantity of goods, amount of the price, transport costs, distance, etc.), the Seller is always entitled to ask the Buyer to authorise the order in an appropriate way, e.g. by telephone or in writing. If the Buyer refuses to authorise the order in the requested manner, the Seller shall have the right to withdraw from the concluded purchase contract.
Completing and sending an order within the meaning of this article of the terms and conditions through the website www.ramissio.com can be combined with registration and creation of a personal user account, which allows the buyer a simplified procedure for making orders (i.e. without re-entering 4 personal data), monitoring the history and status of all their orders. Registered users can also take advantage of a number of benefits offered by the Seller within these Terms and Conditions or separately also through the website www.ramissio.com.
4. Buyer registration
Registration means filling in the relevant form on the website www.ramissio.com, indicating acceptance of these terms and conditions and confirming acceptance of the registration by the Seller.
When registering, the person is obliged to fill in all the data marked as mandatory, truthfully, correctly and completely. If any information changes during the term of the legal relationship, the registered user is obliged to update this information without delay. The data provided by the buyer in the user account and when ordering goods are considered correct by the seller.
On the basis of registration, the Seller shall set up a user account for the User, i.e. the User's own user interface, where access will be secured by a user name and password and where it will be possible, for example, to manage the User's account, change the data entered during registration, etc.
The buyer is obliged to maintain the confidentiality of the information necessary to access his user account. The Buyer is not entitled to allow third parties to use his/her user account.
Each user is fully responsible for his/her account login details and is obliged to protect them from any disclosure to others. If any person other than the user gains access to the user account using the user name and password, the seller shall not be liable for this or for any negative consequences for the user.
The Seller may terminate the user account, in particular if the Buyer requests it, if the Buyer does not use the user account for more than 1 year, or if the Buyer breaches its obligations under the Purchase Agreement (including the Terms and Conditions).
The Buyer acknowledges that the user account may not be available continuously, especially with regard to necessary maintenance of the Seller's hardware and software equipment or necessary maintenance of third party hardware and software equipment.
5. Price and payment terms
The prices quoted on www.ramissio.com are valid at the time of ordering and include VAT. The prices refer to the products illustrated and described.
Payment of the purchase price shall be made in the currency of the Czech koruna, euro or other currencies set in the shop.
The buyer can choose from three methods of payment of the purchase price during the order process:
Cashless via the GoPay payment system, Shop Pay, Google Pay.
Cash on delivery.
The buyer agrees to pay the shipping costs together with the price of the goods.
6. Transport conditions, postage
Shipping will be provided by the selected shipping company (GLS). The actual shipping price is always displayed during the order. If shipping is free, the customer does not pay for shipping.
7. Delivery time
Goods marked as "in stock" will generally be shipped to the buyer within 7 working days of receipt of the order or the buyer will be notified within this period that the shipment cannot be delivered within this period.
In all other cases, the goods will be dispatched subject to availability, within 30 days of the date of receipt of the order at the latest. In case of long-term unavailability of goods, the Seller shall contact the Buyer in order to agree on a possible solution (e.g. extension of the delivery period, withdrawal from the contract, change of ordered products, etc.).
If the subject of the delivery is both goods marked as in stock and goods that are not in stock, the goods are usually sent to the buyer only after all items are available, unless the buyer agrees otherwise with the seller.
The Buyer is obliged to accept the goods from the carrier properly, check the integrity of the packaging, the number of packages and in case of any defects immediately notify the carrier of the defects found. This is without prejudice to the rights under warranty or liability for defects. The invoice and tax document are sent by e-mail in PDF format to the e-mail address provided by the buyer.
8. Ramissio rewards program
The customer has the opportunity to recommend Ramissio products to his friends. For each new user who orders goods via a unique commission discount code generated by the system, the buyer who recommended Ramissio products is entitled to a reward of 10% of the price of the products including VAT for his/her 1st order. The newly referred customer will receive a 10% discount on the price of the products including VAT on his/her 1st order. Participation in the Ramissio rewards program is purely voluntary.
Overview of the benefits of the Ramissio Rewards Programme:
Credits for each purchase: 1 CZK credit for every 10 CZK of your order, double credits for multiple orders within 30 days. Credits are always valid for 60 days.
You can then use the accumulated credits to obtain a discount code of any amount. The amount of the discount can be up to a maximum of 50% of the total order price, the rest you pay in the normal way. Discount codes are valid for 60 days.
Reward 10% of the price of products including VAT on the 1st order of friends registered with your unique commission discount code.
A friend with your unique commission discount code receives 10% off the price of products incl. VAT on the 1st order.
9. Legal guarantee for conformity of goods with the contract, rights from defective performance
If the Buyer discovers defects in the goods for which the Seller is responsible, the Buyer shall notify the Seller without undue delay after discovering such defects.
Complaints can be addressed in particular in writing, both in paper and electronic form, i.e. by e-mail to the following address: objednavky@ramissio.com.
The rights and obligations of the contracting parties with regard to rights arising from defective performance shall be governed by the applicable generally binding regulations. All goods are covered by a guarantee corresponding to the expiry date indicated on the goods or their packaging.
The Seller is obliged to hand over to the Consumer the goods that comply with the Purchase Contract. In particular, the seller shall be liable to the consumer that at the time the goods were handed over to the consumer:
it corresponds to the seller's description and has the characteristics which the seller has demonstrated to the consumer in the form of a sample or specimen, as the case may be;
is fit for the purposes for which goods of that kind are normally used;
it has the quality and characteristics which are usual for goods of that kind and which the consumer may reasonably expect having regard to the nature of the consumer goods and, in particular, to the public representations made in advertising or on labels by the seller, the manufacturer or his representative as to the particular characteristics of the goods.
The buyer is advised to check the condition of the consignment (number of packages, integrity of the tape, damage to the box, etc.) with the carrier immediately upon delivery according to the enclosed delivery note. The buyer is entitled to refuse to accept a shipment that does not conform to the contract of sale on the grounds that the shipment is incomplete or damaged, for example. If the buyer accepts the damaged shipment from the carrier, the damage must be described in the carrier's handover report. The incomplete or damaged shipment must be reported by e-mail to the Seller at objednavky@ramissio.com, a damage report must be drawn up with the carrier and sent to the Seller by e-mail or by post without undue delay. Failure to comply with the rules of this point does not affect the buyer's rights under liability for defects or warranty.

10. Withdrawal of the buyer (consumer) from the contract
If the purchase contract is concluded by means of distance communication (online shop), the buyer, if he is a consumer, has the right to withdraw from the contract without giving any reason within a period ending on the 14th day from the day on which the consumer or a third party designated by him (other than the carrier) takes physical possession of the goods (if the subject of the purchase contract is several types of goods or the delivery of several parts, this period starts from the day of receipt of the last delivery of goods). Withdrawal from the contract of sale must be sent to the seller within the period specified in the previous sentence. To facilitate communication, it is advisable to indicate the date of purchase or the contract/sales receipt number, the bank account and the chosen method of return.
The consumer may send the withdrawal from the purchase contract, inter alia, to the designated e-mail address of the seller objednavky@ramissio.com.
If the consumer withdraws from the contract, he/she shall send or hand back to the seller the goods received from the seller without undue delay, but at the latest within 14 days from the date on which he/she has notified the seller of his/her decision to withdraw from the contract, at his/her own expense. The deadline shall be deemed to have been met if the consumer sends the goods back before the expiry of 14 days. The consumer should return the goods complete, with full documentation, undamaged, clean, preferably including the original packaging, in the condition and value in which they were received. The consumer is liable to the seller for any diminution in the value of the goods resulting from handling the goods in a manner other than that necessary to acquaint him with the nature, characteristics and functionality of the goods.
If the consumer withdraws from the contract, the seller shall reimburse the consumer without undue delay and no later than 14 days from the date on which the consumer was informed of the decision to withdraw from the contract, all payments received from the consumer under the contract, except for the cost of delivery of the goods in excess of the cheapest standard delivery method offered by the seller. The seller shall use the same means of payment to reimburse the relevant payments as the consumer used to make the initial transaction, except where the consumer has expressly agreed to a different method of reimbursement and provided that no additional charges are incurred by the consumer.
However, where the consumer withdraws from the contract, the seller shall not be obliged to return the payments received to the consumer before the consumer has received the goods or before the consumer has proved that he has sent the goods back to the seller, whichever is the earlier.
The consumer has the right to withdraw from the order at any time before the goods are dispatched and without any penalty. Cancellation may be made by email to the Seller's designated email address objednavky@ramissio.com with the text "I withdraw from the order dated DD. MM. YYYY No. (order number)". However, failure to comply with this text does not invalidate the withdrawal if it is otherwise sufficiently certain.

11. Withdrawal from the contract by the seller in special cases
The Seller reserves the right to withdraw from the contract or the part of the contract to which the reason relates in the following cases:
The goods are no longer manufactured or delivered, or production is temporarily suspended, or are otherwise unavailable to the Seller even with the exercise of professional care.
However, the Seller does not have the aforementioned withdrawal options for goods that were marked as "in stock" at the time of conclusion of the contract.
12. Final provisions
These terms and conditions shall apply as published on the Seller's website www.ramissio.com.com on the date of sending the electronic order, unless otherwise agreed in writing between the parties. The Seller therefore reserves the right to modify its terms and conditions at any time by publishing changes online on the website www.ramissio.com. The new version of the terms and conditions shall enter into force and effect at the moment of publication according to the previous sentence.
The provisions of the Terms and Conditions shall be governed by the law of the Czech Republic (hereinafter referred to as "applicable law").
All disputes arising from the Purchase Contract subject to these Terms and Conditions shall be decided by the Czech courts with jurisdiction in the matter and place of jurisdiction.
Notwithstanding the foregoing, nothing in these Terms and Conditions shall diminish any rights that may accrue to the Buyer under applicable consumer protection laws or other relevant laws.
